PRIVACY POLICY
1. LEGAL BASIS FOR PROCESSING
Phixit collects and processes personal data under the following legal bases as provided
under Sections 30–33 of the DPA:

1. Contract Performance: To verify your identity, match you with Clients, process payments,
and manage service engagements.
2. Legal Obligations: To comply with taxation, employment, and regulatory requirements.
3. Legitimate Interests: To ensure platform integrity, improve service quality, and maintain
safety and security.
4. Consent: For optional communications, marketing, or processing of non-essential
information.
2. CATEGORIES OF PERSONAL DATA COLLECTED
Phixit may collect and process the following categories of personal data from Workers:

1. Identification Data: Full name, phone number, email address, photo, national ID, and KRA
PIN.
2. Professional Data: Skills, qualifications, licenses, certifications, and background checks.
3. Financial Data: M-Pesa or bank details for payments, and transaction history.
4. Service Data: Job details, Client feedback, ratings, and performance metrics.

5. Location Data: Collected when you are actively logged in or performing a service.
6. Device Data: Device type, operating system, and App usage analytics.
Phixit may collect this data directly from you, or indirectly from third-party verifiers,
regulators, or lawful data sources.
3. PURPOSE OF DATA COLLECTION
Your personal data is collected and processed for the following purposes:

1. To verify your identity and professional credentials;
2. To match you with suitable Client service requests;
3. To process payments, commissions, and maintain transaction records;
4. To manage your Worker account and monitor performance;
5. To provide customer support and resolve disputes;
6. To ensure compliance with labour, tax, and data protection laws; and
7. To improve App functionality and enhance user experience.
4. DATA SHARING AND DISCLOSURE
Phixit may share your personal data only when necessary and for legitimate purposes,
including with:

1. Clients who request your services through the App;
2. Payment processors and secure data storage providers;
3. Regulatory authorities or law enforcement agencies, where required by law.
4. All third-party processors engaged by Phixit are bound by written agreements ensuring
compliance with the Data Protection Act, 2019 and applicable regulations.

Phixit does not sell, rent, or trade personal data to any third party.
5. DATA SUBJECT RIGHTS
Under Part V of the Data Protection Act, 2019, you have the right to:

1. Be informed of the use and purpose of your personal data;
2. Access your personal data held by Phixit;
3. Request correction or deletion of inaccurate data;
4. Withdraw consent to processing (subject to legal or contractual restrictions); and
5. Object to processing or request limitation of processing in certain circumstances.

6. DATA RETENTION
Phixit shall retain personal data only as long as necessary for the purposes for which it was
collected or as required by applicable laws.

Worker account data and related information shall be deleted after six (6) months of
inactivity, unless retention is required for compliance, dispute resolution, or enforcement of
legal rights.
7. DATA SECURITY AND BREACH NOTIFICATION
Phixit applies appropriate technical and organizational safeguards to protect your personal
data from unauthorized access, disclosure, alteration, or destruction. These include:

1. Encryption of stored and transmitted data;
2. Secure servers and restricted data access;
3. Password and authentication controls;
4. Regular system testing, security monitoring, and staff confidentiality obligations.

Phixit shall implement reasonable technical and security measures to protect user data. In
the event of a personal data breach, Phixit shall promptly notify the Data Commissioner and
affected individuals as required under Sections 43–45 of the Data Protection Act, 2019.
Phixit shall not be liable for any loss or damages arising from unauthorized access, hacking
or system intrusion.
8. DISPUTE RESOLUTION
Any dispute arising out of or in connection with the use of the App shall first be resolved
amicably through negotiation.

If unresolved within thirty (30) days, the dispute shall be referred to arbitration in Nairobi,
in accordance with the Arbitration Act (Cap 49, Laws of Kenya). The arbitrator’s decision
shall be final and binding.
9. LIMITATION OF LIABILITY
You acknowledge that you operate as an independent contractor, not as an employee, agent,
or representative of Phixit.

You are solely responsible for your tax, statutory, and insurance obligations.
Phixit shall not be liable for any loss, damage, injury, or dispute arising from your
performance of services.

10. TERMINATION
Phixit may suspend or terminate your account without prior notice if:

1. You breach these Terms or applicable laws;
2. You engage in fraudulent, unethical, or abusive behavior; or
3. You receive repeated Client complaints or low performance ratings.

Upon termination, any outstanding payments may be withheld pending the resolution of
disputes or investigations.
11. GOVERNING LAW AND JURISDICTION
This Policy shall be governed by and construed in accordance with the laws of the Republic
of Kenya.

Subject to the arbitration clause above, the courts of Nairobi, Kenya shall have jurisdiction
over any disputes arising under or in connection with this Policy.

13. POLICY UPDATES
Phixit reserves the right to amend or update this Policy from time to time to reflect changes
in law, technology, or operational requirements. Updates shall take effect upon publication
on the App or the official Phixit website. Users are encouraged to review this Policy
regularly.
14. ACKNOWLEDGEMENT
By registering for and using the Phixit Worker App, you acknowledge that you have read,
understood, and agreed to be bound by these Terms of Use and Privacy Policy.
