PHIXIT WORKER APP – TERMS OF USE
1. INTRODUCTION
Phixit Services Limited (“Phixit”, “we”, “us”, or “our”) operates the Phixit Worker App (the
“App”), a digital platform that enables verified independent service providers (“Workers”,
“you”, or “your”) to receive, manage, and perform service requests from clients (“Clients”)
seeking professional services. Phixit acts solely as an intermediary and facilitator. Each
Worker operates as an independent contractor and is not an employee, agent, or
representative of Phixit.

This Terms of Use and Privacy Policy (“Policy”) explains how Phixit collects, uses, shares,
and protects your personal data, and sets out the terms governing your use of the App, in
compliance with the Kenya Data Protection Act, 2019 (the “DPA”) and the Data Protection
(General) Regulations, 2021.

By using the App, you confirm that you have read, understood, and agreed to be bound by
this Policy. If you do not agree, please discontinue use of the App immediately.
TERMS OF USE
1. ELIGIBILITY
To use the Phixit Worker App, you must:
1. Be at least eighteen (18) years old;
2. Be legally permitted to work in Kenya; and
3. Provide valid identification and, where required, proof of qualifications or licensing.
Phixit reserves the right to verify all credentials and deny access if eligibility
requirements are not met. Any falsified or misleading information may result in account
suspension or termination.
The Phixit Worker App is strictly intended for persons aged 18 years and above. Phixit does
not knowingly collect or process data from minors. If such data is inadvertently collected, it
will be permanently deleted upon discovery.

2. ACCOUNT MANAGEMENT
You must provide accurate, complete, and truthful information when creating your
account.
Phixit may verify the details provided and may suspend, restrict, or deactivate accounts
found to contain false, incomplete, or misleading data.
You are solely responsible for maintaining the confidentiality of your login credentials
and for all activities conducted under your account.
You must immediately notify Phixit at support@phixit.co.ke in the event of any
unauthorized use or suspected security breach.
3. SERVICES AND CONDUCT
By using the App, you agree to conduct yourself professionally and ethically at all times.
You must:
1. Deliver services with skill, diligence, and professionalism;
2. Arrive on time and communicate promptly and courteously with Clients;
3. Respect Clients, their property, and their privacy;
4. Avoid any form of harassment, discrimination, or misconduct; and
5 Refrain from soliciting or accepting off-platform work originating from the App.
Repeated misconduct, fraud, poor performance, or low client ratings may result in
account suspension, withholding of payments, or permanent termination from the
platform.
4. PAYMENTS AND COMMISSIONS
All payments for completed jobs are processed exclusively through the Phixit App.
1. Phixit will deduct a service commission before disbursing payouts to Workers.
2. Payouts are processed weekly, subject to verification of completed services.
3. You must provide valid payment details (e.g., M-Pesa or bank account) to receive
payments.
4. Phixit reserves the right to withhold payments in the event of a dispute, fraudulent
activity, or policy breach pending resolution.

Any attempt to conduct transactions outside the App is strictly prohibited and will lead to
account suspension.

5. REFUNDS AND ADJUSTMENTS
If a Client refund is approved by Phixit:
1. The Worker’s payout for that particular service will be adjusted accordingly.
2. Refunds apply only to transactions completed within the App.
3. Payments made directly between Clients and Workers are not covered by Phixit’s
refund or dispute policy.
Phixit will make refund determinations in good faith and at its sole discretion, based on
available evidence and circumstances.
